1. Who you are contracting with

By placing an order you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

2. Eligibility

You must be at least 18 and capable of entering a contract under the Indian Contract Act, 1872. If you are ordering on behalf of a business, you confirm you are authorised to do so.

3. Our products

• Every GABAYA bag is made from 100% vegan leather with a polyester lining. No animal hide is used in any piece we make.
• All pieces are manufactured in India.
• Because our bags are finished by hand, small variations in grain, colour and stitching are normal and are not defects.
• Photography is reproduced as faithfully as we can manage, but colours may appear differently on different screens.
• Dimensions and weights are stated on each product page. Where a specification is still being confirmed, the page says so rather than giving an estimate.

4. Prices

• All prices are in Indian Rupees (INR) and are inclusive of GST at the applicable rate.
• Shipping is charged separately where it applies; see Shipping & Returns.
• Prices may change at any time, but a change will never affect an order we have already confirmed.
• Some pieces are shown as Price on request. These are not yet offered for online sale; you may enquire about them and we will respond with pricing and availability.

5. How a contract is formed

1. Placing an order is an offer to buy, not a concluded contract.
2. Our on-screen and emailed confirmation acknowledges that we have received your order.
3. A binding contract of sale forms only when we dispatch the pieces in your order.
4. We may decline an order, in whole or in part, where: the piece is out of stock; a price or description was published in error; we cannot deliver to your address; payment is not authorised; or we reasonably suspect fraud. If we decline after taking payment, we refund you in full.

6. Payment

• Online payment is processed by Razorpay, and supports UPI, debit and credit cards, netbanking and wallets. Your card details are entered on Razorpay's own page; we never receive or store them.
• Cash on Delivery is available on eligible orders and delivery locations. Where a limit applies it is shown at checkout.
• If a Cash on Delivery order is refused at the door without a valid reason, we may decline Cash on Delivery on your future orders.

7. Delivery

Delivery terms, timelines and charges are set out on our Shipping & Returns page, which forms part of these Terms. Delivery estimates are estimates, not guarantees. Risk in the goods passes to you on delivery.

8. Returns, refunds and cancellations

Our returns and refunds terms are set out in full on the Shipping & Returns page. Nothing in these Terms limits your rights under the Consumer Protection Act, 2019.

9. Acceptable use

You agree not to:

• Use the site for any unlawful purpose, or in breach of these Terms.
• Place orders that are false, fraudulent, or made in someone else's name without authority.
• Attempt to gain unauthorised access to the site, its server, or its database.
• Scrape, mirror, or systematically extract content from the site.
• Interfere with the site's operation, including by introducing malicious code.

We may suspend or refuse service to anyone who breaches this section.

10. Intellectual property

The GABAYA name and mark, the designs of our bags, and all photography, text and layout on this site are owned by GABAYA or used under licence. You may view and share pages for personal, non-commercial purposes. You may not reproduce, sell or use our content commercially, or use our name or marks, without our written permission.

11. Third-party links

This site links to third-party services, including Instagram and our marketplace listings. We are not responsible for their content, terms, or privacy practices.

12. Disclaimers

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free of harmful components. We do not warrant that colour reproduction on your device is exact.

Nothing here excludes any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

13. Limitation of liability

Subject to section 12, and to the extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount you paid for that order.

We are not liable for indirect or consequential loss, or for loss of profit, revenue, business or opportunity, however it arises.

14. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, strikes, civil unrest, government action, courier failure, or failures of telecommunications or power infrastructure.

15. Grievance redressal

As required by the Consumer Protection (E-Commerce) Rules, 2020, our Grievance Officer is:

16. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to any right you have to approach a consumer forum where you reside, the courts at Jaipur, Rajasthan have exclusive jurisdiction over disputes arising from them.

We may amend these Terms from time to time. The version in force when you place your order is the version that applies to it. The "Last updated" date above shows the current version.
